"we," "us," or "our").
Information We Collect
We collect personally identifiable information, like names or nicknames, email addresses,
login credentials, and similar details, when voluntarily submitted by our visitors — for
example when a parent creates a family account, adds a child to that account, writes a
letter to Santa, builds a wish list, or shares a wish list with friends or family by email.
Specifically, we may collect:
- Account information: a name or nickname, email address, username, and password (stored in encrypted/hashed form, never in plain text) for parents/guardians and, where a parent sets one up, for their children.
- Letters to Santa: the text a child or family writes, and Santa's reply.
- Wish lists: item names, links, images, quantities, and notes family members leave for each other (including private "will give" notes used to coordinate gift-giving, which are never shown to the wish list's owner).
- Email addresses of people a family chooses to share a wish list with.
- Technical information such as your IP address at the time you register, and standard server log data (browser type, pages requested, timestamps) generated by visiting the Site.
The information you provide is used to fulfill your specific request. This information is only used to fulfill your specific request, unless you give us permission to use it in another manner — for example, to add you to one of our mailing lists.
Children's Privacy
DearSanta.com is a service designed to be used by children together with a parent or legal
guardian, and we take children's privacy seriously, consistent with the Children's Online
Privacy Protection Act (COPPA). A child does not get full, independent access to the Service
without a parent or guardian's involvement: either a parent creates the family account and
sets up each child's login themselves, or a child who starts the sign-up process must provide
a parent's email address, and the resulting account is limited until the parent completes
set-up. We do not knowingly collect more personal information from a child than is reasonably
necessary to provide the letter-to-Santa and wish list features of the Service, and we do not
use information collected from children to serve targeted or behavioral advertising, and we
do not sell children's personal information.
Because a letter to Santa is free-form text written by a child, it may end up containing personal details the child chooses to include (for example, a home address, a school name, or a family member's name). We use letter content only to generate and send Santa's reply and to operate the Service, and we encourage parents to review letters with their child before they are sent. A parent or guardian who wants to review, correct, or delete the personal information we have collected from or about their child, or to refuse further collection or use of that information, can do so through the account's family dashboard or by contacting us at the address below — we will verify that the request comes from the child's parent/guardian before acting on it.
Cookie/Tracking Technology
The Site uses a small number of cookies that are strictly necessary to make it work: a login
session cookie so you stay signed in, and a security ("CSRF") cookie used to protect forms
from cross-site request forgery. We do not currently use advertising cookies, third-party
analytics cookies, or cross-site tracking technology on the Site. Aggregate, non-identifying
technical information (such as browser type or general usage patterns) may be reviewed
internally to keep the Site running reliably and secure.
How We Use Your Information
We use the information described above to: operate the letter-to-Santa and wish list
features you request; create and manage family and child accounts; send transactional email
(account confirmations, password resets, notice that a letter has been sent or answered,
wish list sharing notices); send occasional newsletters or announcements to users who have
not opted out; keep the Site secure and prevent fraud or abuse; and improve the Service.
Service Providers
We use a third-party email delivery provider solely to transmit the emails described above
(such as Santa's replies and account notifications) on our behalf. That provider is only
permitted to use the information we share with it to deliver those emails for us, not for
its own independent purposes.
Distribution of Information
We do not sell personal information. We may share information with governmental agencies or
other companies assisting us in fraud prevention or investigation. We may do so when: (1)
permitted or required by law; or, (2) trying to protect against or prevent actual or
potential fraud or unauthorized transactions; or, (3) investigating fraud which has already
taken place. The information is not provided to these companies for marketing purposes.
Data Retention
We keep account, letter, and wish list information for as long as the associated account
remains active, or as needed to provide the Service, resolve disputes, and comply with our
legal obligations. A parent/guardian may request deletion of their family's account and
associated data as described above under "Children's Privacy."
Commitment to Data Security
Your personally identifiable information is kept secure. Passwords are stored using
industry-standard hashing, not in plain text. Only authorized employees, agents, and
contractors (who have agreed to keep information secure and confidential) have access to
this information. All emails and newsletters from this site allow you to opt out of further
mailings. No method of transmission or storage is 100% secure, so while we work to protect
your information we cannot guarantee its absolute security.
Your Choices
You (or, for a child's account, the child's parent/guardian) may opt out of marketing/
newsletter email at any time using the unsubscribe link included in those emails or the
unsubscribe page linked in our site footer. This does not affect transactional email tied
to actions you take on the Service, such as a letter being sent or answered. Depending on
where you live, you may have additional rights over your personal information — including
the right to request access to, correction of, or deletion of it, and the right to know that
we do not sell personal information — which you can exercise by contacting us below.
Where Information Is Processed
DearSanta.com is operated from, and personal information is stored and processed in, the
United States. If you access the Site from outside the United States, you understand that
your information will be transferred to and processed in the United States.

Accounts, Eligibility, and Parental Responsibility
DearSanta.com is intended to be used by children together with the involvement of a parent
or legal guardian. An adult creating a family account, or a parent/guardian who authorizes
or sets up a child's account, represents that they have the authority to do so on behalf of
that child, and is responsible for that child's use of the Service, for keeping the family's
login credentials secure, and for reviewing the child's activity on the Service (including
letters written and wish lists created). You are responsible for maintaining the
confidentiality of your account password and for all activity that occurs under your
account. Please notify us promptly at the contact information below if you believe an
account has been used without authorization.
Your Content
Letters you write to Santa, wish lists, wish list items, and notes you leave for family
members ("your content") remain yours. By submitting content to the Service, you grant
DearSanta a limited license to store, reproduce, and transmit that content solely as needed
to provide the Service to you and the family members you share it with — for example,
generating and sending a reply to a letter, or showing a shared wish list to the people you
chose to share it with. We do not publish your content publicly or use it for advertising.
You agree not to submit content that is unlawful, abusive, or that you do not have the right
to share.
About Santa's Replies
Replies to letters sent through the Service are automated messages provided for
entertainment purposes as part of the DearSanta.com experience. They are not personal
correspondence from any real individual claiming to be Santa Claus.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. The Site and Service are provided "as is" and "as available," without warranties of any kind, whether express or implied.
Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.
